Gardasil 9's American patent expires in 2028, the same year as Keytruda's, though a vaccine is harder to copy than a pill.
Gardasil's American franchise, the part that held up in 2025, has its own date. The patent table lists 2028 for Gardasil 9 in the United States1. That is the same year Keytruda's compound patent expires.
There is a small offset. Merck pays a 7% royalty on American Gardasil sales to one third party, and that royalty expires in December 20282. At 2025 American sales of $2,641 million3, it costs about $185 million a year4.
Vaccines are harder to copy than small-molecule drugs; a rival needs its own manufacturing and clinical data, not just a bioequivalence study. But China has already approved a domestic nine-valent vaccine5, which shows the technology can be matched.
The domestic Chinese vaccine shows the technical barrier can be crossed. Its approval, Xinhua reported, made China the second country after the United States able to supply high-valency HPV vaccines independently6. A second producer anywhere is the beginning of a second producer everywhere once patents allow it.
The warning sign would be an American regulatory filing by a competing nine-valent HPV vaccine before 2028. Without one, the patent date matters less for Gardasil than for Keytruda; with one, 2028 becomes a double cliff.
