Merck & Co. (MRK) — moat facet

Merck's own filing says Keytruda copies could reach America in December 2028, and until then the drug keeps growing its share of the company.

Most patent cliffs are argued about. Merck has published its own date. Its annual report says biosimilar competition for Keytruda "could begin in December 2028" when the primary compound patent expires1, and that it expects to lose market exclusivity in Europe in 20312. The patent table lists China in 2028 and Japan in 2032 and 20333.

The American date comes first.

Two further American patents in the composition-of-matter family run to May and November 2029, but Merck expects them to be litigated4, which is why it gives the earlier date. The company is not relying on them.

The exposure is large and growing. Keytruda represented 49% of Merck's sales in 20255, up from about 35.3% in 20216. Every year it keeps growing faster than the rest of the company, the eventual loss becomes a larger share of the whole.

Merck's own experience with exclusivity loss is stated as a general rule: sales fall significantly and rapidly7. Its diabetes drugs show it now: Januvia and Janumet lost American exclusivity in May 20268, and their combined sales fell 31% in the second quarter9.

The date matters for Merck's other large products too. Merck's patent table lists Lynparza's American protection to 2027 and Gardasil 9's to 202810, and Bridion lost American exclusivity in July 202611. The Keytruda date is the largest on the calendar, not the only one.

The calendar cannot move, so the question is what fills it. Keytruda sales grew about 7.3% in 202512; the growth rate is worth watching less for itself than against the rest of the company, because a Keytruda that keeps outgrowing everything else until 2028 makes the cliff steeper, not gentler.
