Johnson & Johnson (JNJ) — threat to the moat
J&J has offered $5.5 billion to end fifteen years of talc litigation, and the deal only works if 95% of claimants take it.
The largest risk J&J has carried for a decade is baby powder. As of June 2026 there were approximately 76,000 plaintiffs in the United States with direct claims against the company over body powders containing talc, primarily Johnson's Baby Powder1. J&J made the commercial decision to discontinue talc-based Johnson's Baby Powder globally in 20232, and kept all the talc-related liabilities when it separated Kenvue3.
The cost has swung wildly because the legal route kept changing. A July 2018 verdict of $4.7 billion in Ingham was reduced on appeal to $2.1 billion4. The company's talc subsidiary filed for bankruptcy in October 2021 and again in April 2023; both petitions were dismissed5. A 2024 plan offered a present value of approximately $6.475 billion over 25 years6, and J&J recorded talc charges of about $7.0 billion in 2023 and $5.1 billion in 20247. When the Texas bankruptcy court dismissed the case in March 2025, J&J reversed approximately $7 billion of reserves8, which is why its 2025 earnings look so large.
In July 2026 the path changed again. After plaintiffs withdrew their specific-causation experts in two bellwether cases, the multi-district litigation court ordered them to show why the remaining claims should not be dismissed9. J&J then announced a proposed resolution: a $5.5 billion commitment, with the first payment of no more than $3 billion in 2027 and nothing more before 2028, conditioned on participation by at least 95% of the remaining claims10. That works out to about $72,000 per claim11.
The reserve was approximately $3.7 billion at the end of June 202612, so the proposal implies roughly $1.8 billion more13. For a company earning about $26 billion of adjusted net earnings a year14, that is manageable.
The mesothelioma cases, the other main category, have largely been dealt with: J&J says it previously settled about 95% of filed mesothelioma lawsuits, all state consumer protection claims and all talc-supplier disputes15. The ovarian cases are what remain, and the July proposal is designed to end them.
Talc has become a quantifiable cost rather than an open-ended threat, if the resolution holds. The participation rate decides it: below the 95% condition, the settlement fails and J&J returns to trying cases one at a time.
The gap is the likely charge; participation below the 95% condition sends J&J back to trying cases.
