Part of Merrill's income is the spread on clients' idle cash, and regulators have already made Bank of America settle over it.
Wealth businesses earn money on the cash clients leave uninvested, and that earning has drawn regulators' attention. Bank of America's risk factors say it has entered into orders or settlements with certain government agencies regarding the rates paid on uninvested cash in brokerage and investment advisory accounts1.
The issue is the same spread that makes the deposit franchise profitable. Cash in a brokerage account swept into the bank at a low rate is cheap funding; clients and regulators can argue that the rate is too low.
The Global Wealth & Investment Management segment earned $7,197 million of net interest income in 20252, on client deposits and loans. That is about 29% of the segment's revenue3.
The same annual report lists orders or settlements on credit card sales and marketing and representment fee practices4. Regulators have repeatedly examined the places where the bank earns a spread without the customer noticing, and client cash is one of them.
The segment's net interest income is the line exposed. A fall in it while rates were steady would say the bank was paying clients more for their cash, voluntarily or not.
