Tesla (TSLA) — threat to the moat

Solving autonomy technically is not the same as being allowed to deploy it.

Even if Tesla solves autonomy technically, deploying it at scale is not Tesla's decision to make — it is the regulators'. Robotaxis and full self-driving must be approved jurisdiction by jurisdiction, by safety authorities that move cautiously and answer to a public deeply wary of computers driving cars, and a single high-profile crash involving an autonomous Tesla could trigger investigations, recalls, and a freeze that sets deployment back years. The technology, however good, runs into a regulatory gate Tesla does not control.

The danger is that the robotaxi and autonomy revenue central to Tesla's valuation could be delayed or constrained by regulation long after the software is ready. Approvals are slow, patchy across states and countries, and vulnerable to political backlash and unsettled liability questions — who is responsible when an autonomous car kills someone? Tesla's approach, deploying capable-but-supervised software broadly to consumers, has also drawn particular regulatory scrutiny over safety and marketing, adding legal and reputational risk.

Tesla is working with regulators and expanding its robotaxi service where permitted, and the long-term regulatory direction may well favor autonomy as its safety record accumulates. But an owner should recognize that the timeline and scale of the autonomy payoff depend heavily on regulators and public trust, not just on engineering, that a single serious accident could impose a lengthy setback, and that the software edge, even fully realized, must pass through a gate that is slow, cautious, and outside the company's control — the robotaxi service operates only where regulators permit, supervised1.
